By accessing or using Thumbify AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Thumbify AI. We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service following any modifications indicates your acceptance of the modified Terms.

To use Thumbify AI, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information is accurate and up-to-date

Thumbify AI reserves the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or illegal purposes.

Subscription Plans

• Thumbify AI offers various subscription plans with different features and credit limits
• Plan details, pricing, and features are displayed on our pricing page
• Prices are subject to change with reasonable notice to existing subscribers

Billing

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• You authorize us to charge your payment method for all applicable fees
• Failed payments may result in suspension of service

Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You will retain access to paid features until the end of your billing period

To ensure quality service for all users, you agree not to:

• Use automated systems or bots to access the Service excessively
• Attempt to bypass credit limits or abuse the free tier
• Share account credentials with unauthorized users
• Resell access to the Service without authorization
• Use the Service to create content that is illegal, harmful, or violates third-party rights
• Create thumbnails containing hate speech, violence, or explicit content
• Infringe on intellectual property rights of others

Violation of the fair usage policy may result in account suspension or termination without refund.

While we strive to maintain high availability, Thumbify AI does not guarantee that the Service will be available at all times. We reserve the right to:

• Perform maintenance that may temporarily affect service availability
• Modify, suspend, or discontinue any feature at our discretion
• Limit service access in cases of excessive usage or abuse

We are not liable for any losses or damages arising from service interruptions or unavailability.

Thumbify AI may terminate or suspend your account immediately, without prior notice, if:

• You breach any provision of these Terms
• You engage in fraudulent or illegal activity
• Your actions harm other users or the integrity of the Service
• Required by law or legal process

Upon termination, your right to use the Service will cease immediately. Any credits, subscription time, or other benefits will be forfeited without refund.

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of Thumbify AI shall be resolved exclusively in the courts located in India. You agree to submit to the personal jurisdiction of such courts.
